Confirming an order for items displayed on the website www.ramirezguitarshop.com implies the express acceptance by the buyer of these general terms of sale, without the need for a signature to confirm such acceptance.

Clause 2. Items.
2.1.Items
The products displayed comply with current Spanish legislation and regulations applicable in Spain.
Images are illustrative of the products on display and correspond to items for sale. However, given the handcrafted nature of the items and the origin of the raw materials used, said images cannot be accurate. Nevertheless, the description of an item includes a list of its main features.
Furthermore, if the product received should have any manufacturing flaw or should not be adequate for its intended purpose, JRG MÚSICA, S.L. will place the necessary means at the disposal of its customers to retrieve the item free of cost, except for transport expenses, and try to replace it.
Regarding items with manufacturing flaws, JRG MÚSICA, S.L. shall, as relevant, repair or replace the item, reduce the price or cancel the contract; processes that will be free of cost for customers and users if the purchase is made under said regime. Customers have two months from the date of reception to notify the seller of any issue regarding the items.
If JRG MÚSICA, S.L. should identify any severe abuse by customers of the product return procedures, it may take the necessary measures to put an end to said abuse.
2.2. Warranty.
JRG MÚSICA, S.L. guarantees the items acquired on its website against any manufacturing defects for two years from the date of delivery.
The warranty does not include defects caused by negligence, blows, undue use or tampering, incorrect assembly and/or use when not carried out by an approved technical service where appropriate, or materials subject to wear from normal use.
To execute the warranty, customers should contact the JRG MÚSICA, S.L. Customer Service and provide the warranty certificate together with the supporting documentation of the order.
Clause 3. Price
3.1 – The prices of our items are expressed in Euros including all taxes. Administrative and shipping fees are not included and will be specified once the final confirmation of an order is received.
3.2 – JRG MÚSICA, S.L. reserves the right to change its prices at any time. However, the products offered will be invoiced based on the prices in effect when an order is placed.
3.3 – All products shall remain the property of JRG MÚSICA, S.L. until they are paid in full to JRG MÚSICA, S.L.
3.4 – In any case, Products sold through the website shall be subject to the taxes and tariffs that legally correspond, especially and in the case of sales in Spain, to value added tax or IGIC (Indirect Canary Island General Tax), if relevant.

Contractual information is expressed in Spanish and must be confirmed and collected before any delivery is made.
JRG MÚSICA, S.L. reserves the right to cancel or refuse an order from a customer with whom it is in dispute regarding the payment of a previous order.
We shall accept an order based on the general terms and conditions of sale set out on the website.
Customers must state they are aware of and accept the said general terms and conditions of sale before confirming their orders.
Thus, confirming an order implies acceptance of these General Terms and Conditions of Sale. Unless otherwise established, the data recorded by JRG MÚSICA, S.L. constitutes proof of all transactions made between JRG MÚSICA, S.L. and its customers.
JRG MÚSICA, S.L. shall do everything in its power to process all orders.
Clause 5 – Availability
Our product range and prices are valid while announced on the website and always depending on available stock.

If, when processing an order, a product is found to be unavailable, we shall notify the customer by email or by phone of the delivery of part of the order, or of the cancellation of the order. Customers will receive the full or partial reimbursement of their orders within 14 days from the notification of the cancellation of an order.
Clause 6. Payment
6.1 Method of payment
Purchases shall be paid by Bank Transfer or by card through a virtual POS.
The price will be charged to the customer’s account within 4 days from the date of the order.
All purchase transactions shall take place within a strict framework of confidentiality and encryption based on the SSL protocol.
When you click on the “Validar” (“Validate”) button to confirm your order, our bank shall verify the validity of the means of payment used and check that it has not been blocked.
JRG MÚSICA, S.L. does not have access to customers’ bank data nor does it save such data on its servers. Therefore, customers will have to provide this information again each time they make a new transaction.
6.2. Secure payment
In keeping with our commitment to the security of all payments, you are hereby informed that JRG MÚSICA, S.L. shall check the reliability of the data provided when placing an order.
This process is part of our commitment against Internet payment fraud and is intended to protect all customers.
Clause 7 – Delivery
7.1 General
JRG MÚSICA, S.L. ships its products to all parts of Spain.
Delivery deadlines depend on order processing and shipping times, which may vary depending on the distribution network our carriers have in each region. Nevertheless, the maximum delivery deadline is 30 working days.
The delivery period of a particular order is indicated in the order summary message and can be viewed in “Mi cuenta / Mis pedidos” (“My account / My Orders”).
The items are sent to the address provided by the customer during the ordering process. To ensure the delivery, when the order is dispatched from the JRG MÚSICA, S.L. facilities, customers will receive an email confirming the shipment so that they can arrange to receive it within working hours.
JRG MÚSICA, S.L. may not be held liable for any consequences caused by delays in the delivery.
7.2 Incidents during the delivery of a product.
On receiving the package, customers must:
Check the goods received.
Point out any anomaly on the delivery note provided by the carrier, stating any reservations and including a signature.
Contact JRG MÚSICA, S.L. within three working days.
If the package is seriously deteriorated when received or if it has been opened, we recommend that you do not accept the delivery. Explain the reasons in sufficient detail on the delivery note and notify JRG MÚSICA, S.L. through our “Contacto” (“Contact”) section so that we can make the necessary checks when we receive the package.
If an order is delayed or does not arrive at its destination, customers can contact our customer service through our “Contacto” section in JRG MÚSICA, S.L. or by phone at +34 915 314 229 (Monday to Friday from 10:00 to 14:00 and from 16:30 to 20:00, Saturdays from 10:30 to 14:00).
If JRG MÚSICA, S.L. should fail to honour its obligation to deliver the goods within the period agreed with the customer, the customer may insist on the delivery taking place within an additional period appropriate to the circumstances. If JRG MÚSICA, S.L. does not deliver the goods in that additional period, the consumer shall be entitled to terminate the contract.
If a package is returned because the delivery failed (mistaken address, collection period elapsed…) the customer will be automatically notified by email. If we do not hear from the customer within 72 hours after reception of the e-mail, JRG MÚSICA, S.L. reserves the right to cancel the order.
7.3 Special situations
Any abusive use or infringement by the customer of the obligations entered into under these General Terms and Conditions of Sale shall result in the suspension or cancellation of the customer’s account depending on the seriousness of the acts in question.
Clause 8. Right of withdrawal and returns.
8.1 Application
Under the Spanish Law 3/2014, of 27 March, amending the consolidated text of the General Law for the Defence of Consumers and Users and other additional legislation approved by Royal Legislative Decree 1/2007, of 16 November, consumers are entitled to a period of 14 days to desist from an on-line contract and exercise their right of withdrawal. This right shall be applicable only in the case the sale takes place under the consumers and users regime, which excludes cases in which the buyer purchases the products for professional use. In addition, this right shall not apply if the product has been custom-made under specific conditions following the buyer’s instructions.
Customers are entitled to 14 working days after reception of the product to exercise their right of withdrawal, if applicable, and return the goods without any penalty other than the shipping charges if the product is returned in the same conditions as it was delivered. The email message with information on the sale will include, in applicable cases, a form with which to exercise the right of withdrawal.
For orders of items, the period starts the moment you receive the products. If the fourteen (14) day period ends on a Saturday, Sunday or a public holiday, it shall be extended to the first business day following said days.

8.2 Returns
In cases of non-compliance or if a customer wishes to exercise his/her right of withdrawal, the products can be returned as follows:
Items must be returned without undue delay and no later than 14 days from the reception of the products. You will not be able to exercise the right of return when there are clear indications the products have been used significantly. When returning an item, it must be appropriately protected, in its original packaging, in perfect conditions so it can be sold at a later date (free from damage, flaws or stains caused by the customer) and together with its relevant accessories and any accompanying documentation.
Customers shall bear the cost of returning the product and of the insurance.
JRG MÚSICA, S.L. may withhold reimbursement until the products have been received.
The reimbursement shall take place using the method of payment used at the time of purchase.
Customers must keep proof of the return shipment, i.e. a written document issued by the carrier or postal service indicating the sender and recipient of the returned product in proof of the effective shipping of the items.
When returning non-compliant or defective products, customers shall fill in a statement of non-conformity. Once we receive the package at our warehouse, if the reason for the return of the product proves to be false, up to 10% of the reimbursement due may be deducted.

The return of the products ordered will result in the reimbursement of the purchase price paid by the customer, minus any penalty incurred and any additional costs if the customer selects a delivery method other than the least expensive mode of delivery, minus return costs.
The return of part of the items ordered will result in the reimbursement of the returned items. Initial delivery costs will not be reimbursed because the price of transport costs is calculated at a flat rate and does not depend on the number of items ordered.
In all cases, an email will be sent to the customer informing of the reimbursement.
JRG MÚSICA, S.L. may withhold the funds until the items have been received or until their condition has been verified at the workshop.
We ask our customers to keep proof of shipment until we confirm we have received the order at our facilities.
Cash on delivery shall not be accepted.
Reimbursements cannot be made to credit cards that have expired. In these cases, JRG MÚSICA, S.L. reserves the right to ask customers to provide the necessary data to repay the funds using an alternative method.
If a customer has used vouchers, the reimbursement will include reissuing the same vouchers.
Clause 9. Changes
The information that appears on this website is current on the date of its latest update. JRG MÚSICA, S.L. reserves the right to update, change or delete information on this website.
JRG MÚSICA, S.L. reserves the right to change the general terms and conditions of sale, as well as the terms and conditions of use of this website. Any changes will be announced. Changes to the terms and conditions of use will come into force once they are published on this website.
